court backs school rezoning -- 03/18/05 !
moti Khemlani and Tuscawilla Home Owners Assoc. minions get slapped down !
State administrative Judge gives blessings to County School Board. Finds School Board did nothing illegal in their redistricting of school districts. Interveners have but one avenue for appeal to the appellate court, and that is if the Judge made a judicial technical error.
That would be strictly a long shot. The Tuscawilla attorney was probably working "pro bono". Khemlani wouldn't be stupid enough to spend membership money on such a frivolous suit like he has misused other monies. The membership should look in on his activities of spending their dues.
Some interesting observations came out during the time preceding the Judge's ruling that in all probability weren't known to the average citizen expecting results from the intervention. Here's some of the contents of some of those emails contents ---
|
Intervenor has 2,109 member households; 734 member households are in Cells 10 and 11. (That's a far cry from Moti boasting that the THOA represented 4,500 homes. Even their IRS tax returns show less, so he and his cohorts haven't been telling the TRUTH What happened to the other 2,391 members? That tells me, Moti really doesn't want to "secure the educational opportunities" as much as he wants to secure publicity for himself.)
|
One of the specific functions of Intervenor is to engage in efforts to secure educational opportunities and a stable educational environment for its members. It has historically worked with the schools to provide increased educational and extracurricular activities for its constituent members. ( This is a far cry from Moti's intervention in this case. Unless Moti's can get HIS name out in the forefront he wouldn't waste his time. He has no children, uses THOA membership money for personal gain (such as paying his attorney fees, and fines in his election fraud), and using membership moneys to pursue needless lawsuits/actions/City elections (Oviedo Mall & Food Lion), and definitely wasn't pursuing increased educational, or extracurricular activities on behalf of All THOA constituents.
|
Damon A. Chase (Attorney for Intervenor) (Moti really has a young attorney in Chase. The guy was admitted to the Florida Bar on May 13, 2003. Chase is barely out of his legal schooling. So, Moti is not paying top dollar like he did for his Oviedo Mall and Food Lion fight. That tells me, Moti really doesn’t want to “secure the educational opportunities” as much as he wants to secure publicity for himself. The attorney Chase just moved into his house in August 2004. Four people from Tuscawilla gave testimony. Moti, Torres (who doesn't live in Winter Springs), Scott Ryerson (former UCF football player), and someone named Desiree Dannecker. How many have kids in high school, and are members of the THOA?)

Some facts concerning the Sabal Point petitioner ---- The lady Jennifer Finch, who filed the lawsuit, her husband Alex was the attorney for the petitioner. One of her arguments was that she is afraid of busing her son from Sabal Point to Lyman. Well, it is just so funny that she was not afraid of her husband’s commute to his law office everyday. His office just so happens to be on SR427, about 1.7 miles from Lyman HS. Don’t you think the father would drive the son to school? Or, if she is so scared, her husband can ride the bus with her son?) |
What makes the whole rezoning process necessary is VERY interesting. Where were these people when the cause of the problem was taking place --- HOME sitting on their hands? They sure didn't protest the cause of the shift from Winter Springs High to Oviedo while Khemlani, Mayor Bush, City Manager McLemore and his "lapdog" commission was forcing the School board to rezone.
The City of Winter Springs with their need to bring MORE people into their floundering "TownCenter" were building and approving multi-storied apartments, condos, high density housing all around their concrete jungle called "Tiny Town". They have to in order to provide the captured businesses with more sales revenue. They cared less for the high school, or even considered what this package of crowded housing developments would cause.
So, when the TRUTH is known, one can lay the blame for the whole mess right down at the feet of the elite in City Hall, and their cohorts such as Khemlani, and the THOA association. They did nothing, and PRAISED the concrete jungle development around the City's fairy tale. The trees and green lands were destroyed to be replaced with the McLemore future slum area of concrete, asphalt, and false facades called the "TownCenter".
The Winter Springs citizens participation in the lawsuit should have sue City Hall, and ALL the people involved in their public deceit, and their OWN rezoning controlled by McLemore and his five "lapdog" commissioners.

Just when we think Moti Khemlani has sunk as low as he can go, he amazes us all once again with his unethical wizardry. Just one look at the SGTV broadcast of the October 26th Seminole County School Board public hearing on the high school rezoning plans is proof of his culpable behavior. In a desperate attempt to sway the School Board’s opinion from rezoning areas of Tuscawilla out of Winter Springs High School to Oviedo High, Moti resorted
Why are we not the least bit surprised that Moti resorted to bribery of public officials to get his and Rick Keel’s way? You will remember that Keel ran an unsuccessful campaign for the City Commission District 3 race on November 2nd. Keel’s single issue platform of putting an $9.5 million competitive swimming pool in Central Winds Park to benefit the Winter Springs High School’s swim team would be tanked without having the full Tuscawilla community in that school. Something drastic had to be done to change the School Board’s mind.
Enter Moti the Flim Flam Man and a bus load of unaccounted for Tuscawilla Homeowners’ Association cash. To get the School Board’s attention, Moti brought a “gift” to the School Board’s feet sans a Trojan Horse. Not only did it involve homeowners’ association funds, it offered up 300 Sanford students to pay the sacrifice.
In order to keep all students within Tuscawilla at Winter Springs High, areas north of Lake Jessup in Sanford would need to be bused to Oviedo High. The quickest route for those students would be to travel SR417 over the Lake Jessup bridge, but it still would be a 9 mile one-way trip for some (12 miles if they use 17/92 and SR434).
Let’s not forget that a lot of those Sanford students are not as privileged as those students from Tuscawilla. Isn’t it a little nasty for the THOA to ask parents of those 300 Sanford kids, with a large percentage of them who qualify for free or reduced lunch, to pay for the gas, mileage, and bridge tolls so they can drive their kids to and from school for after school activities, when their child becomes ill, or school conferences?
Here is the verbatim transcript of Moti Khemlani’s public input as a representative of the THOA Board of Directors at the School Board’s October 26th public hearing:
“I like to state that we had proposed an option in which we would be asking people to cross the bridge and go to Oviedo High School. Our plan has been really the least impactive of all the plans and Option 3 was the pre-generation or generation before Plan Z.
What I am here to tell you is that the Tuscawilla Homeowners’ Association is going to be more than HAPPY to bring a check to Dr. Vogel to pay for the expenses of all the transportation, and all the mileage for the next 5 years … for the next 10 years. We’ll put it in an escrow account so that you people don’t have to worry about the costs of moving people to make sure that the least impactive plan is in place.”
Translated, Moti is loudly saying “Hey School Board, the Tuscawilla Homeowners’ Association will write you a big fat check to pay for the costs of busing those 300 Sanford students over Lake Jessup into Oviedo for the next 5 to 10 years, if you pick our Plan Z that will keep all Tuscawilla students at Winter Springs High.” ( Can you image how many hundred-thousands of dollars this would have cost the members of the Homeowner's Association without them of even knowing what was going on? Would this have come out of the TLBD tax assessment funds ? )
Folks, it doesn’t matter how you slice 'em, or dice it, Moti resorted to bribery with a candidate for municipal office cheering him on. Now, isn’t that a pretty picture?
With the final decision on the rezoning plans to be made by the School Board on November 29th and hopes running dim for some areas of Tuscawilla, what unethical means will Moti resort to next and which School Board official will he skewer in his next issue of the Tuscawilla Today? Time will only tell. As for Keel, maybe he can open up an aquatics center using the Tuscawilla entrance pond as a swimming pool.
We ask: What citizen in Winter Springs wants to be strapped for paying more taxes to build an $9.5 million pool that would have limited use and high ongoing operational costs? Let’s see what City Commissioner Robert S. Miller will do now to keep the tax referendum for the aquatics center, and its required municipal government expansion alive.

PUBLISHER'S NOTE: It must also be noted that this was the second meeting in which the THOA had voiced their opinions as to the zoning. At previous meetings even Mayor Bush, and Commissioner Gilmore were in the THOA contingency, Bush spoke out against ANY changes. Miller, of course, had his backing by the infamous "Tuscawilla Today" with his ancient photograph published in that propaganda rag.
