A "Special Commission Meeting" of December 16th revealed a shocking fact as to the destruction of trees in the City of Winter Springs. The 9.1 acre development on the west side of the Stone Gable Community, located on SR434, will be allowed to remove 953 trees. Not only that, but the City will allow additional trees to be removed for a "donation" to the "City's Tree Bank" of around $55,000 dollars (?). Are the trees in the "Tree Bank" as large as those being removed ?
Who in the world ever named the City of Winter Springs --- "TREE CITY USA" ? Sounds like the same big ploy the City Manager and Commissioner Miller keep touting that "The City of Winter Springs" was voted "number one" by the MSN Network Home Locator web site. That, too, is a phony, which McLemore/Miller keep repeating. They continue to tout that which cannot be proven. They perpetuate the lie by spending thousand of taxpayers' on a propaganda video, which extols the benefits of living in Winter Springs.

This is for a high density development. The NEW zoning at Parkstone is to bring in NEW sales revenue. The City needs the revenue to replace that which was negligence spent on non-paying projects --- i.e. "The TownCenter" )

The Winter Springs' Arbor Law is so unfair to the residents of the City. As case in point is a gentlemen who came before the City Commission to get permission to remove a tree that is lifting up the concrete in his driveway. He was told he could not remove it. Trees have more rights than the homeowner under this "fascist" control of property rights.
Other cases include an elderly widow, whose water lines were broken by a tree on her property, resulting in a $500 dollar water bill. In another case, a tree is lifting up an air conditioning unit on another property, but removing the tree would be against the Arbor Code of the City of Winter Springs. Now, there is an appeal process, which could take months going through different processes before it even comes before the Commission, and that alone could result in further destruction of this homeowner's property while some bureaucratic job-security-seeking individual rules.
The City of Winter Springs has one of the most arbitrary Arbor Law in the history of a City. Now, if any of the above finally got permission to remove the property-damaging tree, they would then have to plant FIVE TREES in its place. That's not a Law------ that's STUPIDITY from the ruling dais, and the originator of the law !
But wait, there is a life saving process a property owner can indulge in --- it's called ----
THE CITY OF WINTER SPRINGS "TREE BANK" !
This is one of this City's biggest farces when the following obnoxious arbor law is considered ---
If you don't want to plant trees to replace what is taken out, you can buy the trees and place them in the City of Winter Springs' tree bank.
If your tree has a twenty inch diameter/girth you would have to replace it with FIVE ! Why in the world would anyone removing a tree causing destruction of their home want to replace it with FIVE MORE TREES ?
Or, you can place the money you would have spent in the "TREE MONEY BANK" ! Now if that isn't the biggest con job in history --- we've got some more for you --- such as "the check is in the mail" ----, or -----------
How about developers ? Does the City get the money from them after the City Manager allows them to rape the countryside, and remove ALL the trees? Commissioner Martinez has an answer for this one when he said --- "They'll plant new trees, and pretty soon they will replace what they removed". That's the dumbest statement ever issued ---- he'll never live long enough to see the growth he helped destroyed.
Attention citizens of Winter Springs --- call 407-327-5957 and ask the City Manager how much money he's got in his "Tree Bank" ? Since it's public money --- ask him for a copy of the "Tree Bank Statement".
If PFGG had a gaming license, we'd be willing to place a bet on the "Tree Bank Balance" if you want to gamble. Wonder what the odds would be on the "Bank" balance ?
Not only is that a question, but did you know if they grant permission to remove the tree, they charge you for a PERMIT ? It destroys your property, you put into their "Tree Bank", and they charge you additional money for their allowing you the privilege of protecting your property !

So, you have to ask yourself --- "Why on earth would you want to get rid of a destructive tree, AND replace it with five more?" Common sense must prevail, which is sadly missing from our present City administration, when a homeowner is faced with the expense of repairing damage done by a tree, and has to pay the City for its destruction.
How much does the City pay back to the citizens for the removal of trees on properties which they allow developers to rape and pillage? The City would owe the citizens millions! Maybe certain people at certain levels in the City receive "kickbacks" by allowing the pillage to occur.
It looks like someone is going to have to take the City to Court to rid the citizens of this obnoxious law, just to get some relief from this arbitrary "Arbor Law". Demand that the City hold an "OPEN" public meeting on the so-called "ARBOR ORDINANCE", and make them publish the issue in the news media so they can't hide it at one of their midnight sessions at the end of the agenda, or probably just don't let you know..
winter springs citizens must take back their city, or better yet --- their private property rights !
