Mayor Partyka ----- "Commissioner Martinez".

Commissioner Martinez --- "In the past recent election ( it was a referendum -- Martinez must not know the difference ) dealing with the Dyson Annexation, --- ah --- , the people that went to stand in front of the polling place in the 75th Election District were very harshly treated by the person in charge of the of the church (diocese property ), and the police were called, and the police responded. The police were told what the rules were. After I left, -- ah --- , another member of the community ( Warner -- President of the THOA ) went there. The police were called again and they, in fact, ordered this man off the premises, based on the insistence of the attorney and the priest in charge of the church over there, because they were not allowed to be within the church premises or the grounds for the purposes of electioneering or whatever they were doing’ there ( now here he's right --- they're NOT allowed ).

My personal knowledge there was no one there electioneering and causing a disturbance ( this is not what eyewitness reports indicate ). We stood well beyond the distance indicated by the election law from the door to a polling place, and all we did, cause I was there, was greet people as they came in. "Good morning, how are you"? And so forth and so on. This person was very agitated and he, in fact, attempted to throw me and another individual off the grounds ( this was a legal right -- election laws had been violated ).
I refused because I knew what I was doin' ( this is very doubtful, as you will read ). I have a … I wrote to the office of the Attorney General of the State of Florida, and I received a response which basically states that as long as the premises is used as an election place on election day, that no one has the right to remove you—be where they may be, whether it is a church or the White House or -- ah -- , the Garden of Eden (?). No one has the right to remove you as long as you are complying with the law ( they weren't complying with the law ) or you are within the prescribed distance. And I want to bring this to the attention of the Chief, --- who is here --- , because the police were very adamant at one time and they did, ---- ah ----, request that Mr. Warner leave the premises, based on the insistence of an attorney and we have to know what the law is before we start pushin’ people around ( the police knew ). And I asked for an opinion; I have a copy of it and I’ll give this to the City Clerk and if she wants to, she can preserve this copy for me or make copies for the rest of the Commission. When I get an indication from them of the fact that what we were doing was right, ( that's an incorrect interpretation of what was received ) and even though it was a church, and even though it is the property of the church, they have no business chasin’ us from there as long as they are allowed and permitted to be an election district site."

There is discussion of the letter from Brown, Ward to the Attorney General., seeking an opinion.
Martinez continues- "The other issue I want to speak about the fact that in the short time that I’ve been here, and I want you to know I’ve been around the block a few times, and I have been in the pits with the alligators and I have been outside the pits with the alligator killers. And, ah, ---- I resent the fact that at least one individual or possibly two on this Commission, have shown a bias towards me personally, or my position on this Commission. Ah, --- by continuously objecting to important issues that I bring up, by voting down suggestions for ordinances that, in my opinion, are important to the City and its citizens because they don’t like it or whatever, but they don’t give it a chance to be aired out and discussed. The way that even the Mayor, in ’96, when I supported him and came back in ’97, kicked me in my butt in 2000.
In 2000, not only did he kick me in my butt, but he recruited the person to run against me. And I have a statement on the record, with a witness that this is so. If I’m lying, the person that said it is lying. OK.
I resent the fact that many times when I try to put a motion forth, it’s always blocked, depending on what the motion is, if it’s not to the liking of one or two individuals. When I consider every time I come up with a motion or discussion in the best interest of the people of Winter Springs.
I’m not voting a developer; I’m not voting as a financial analyst; I’m not voting as a realtor. I’m voting as an individual elected by the people of the City of Winter Springs to represent their best interests. And I try to do that to the best of my ability. What happened here with a recent resolution on Paw Park, can be seen as discrimination. There’s nothing written, I said it before, and I’ll say it again, anywhere's on the code or anywhere's in City documents that says that one Commissioner has to abide by the wishes of the other four. Nothing. A resolution itself doesn’t say that each Commissioner has a choice and if there’s one Commissioner left over, he has to choose the vacancy that’s left standing. It doesn’t say anything like that.
I take exception to all those issues and I take exception to the fact that I appear to be singled out. A person that gets hurt by prejudice, because I’ve been there --- done that. I know what it’s all about --- I kick back. We’re put here to work together as a team. I think that some of my wishes ought to be respected. Some of my ideas ought to be discussed. And not thrown by the wayside because they don’t like me or they have an attitude against me.
This has been shown very clearly in the pat 4 years. I don’t care what anybody says—I’ve been around the block a few times—I’ve been in the deepest hole there is and I’ve been up at the top. I dealt with the biggest people in this country when I was a detective in New York. I dealt with the lowest crap there is on this earth. There is nobody here that can teach me anything. I learned about legislating since becoming a Commissioner, and I’m doing the best job that I can, but I would appreciate a little respect and a little courtesy from some of my fellow Commissioners here, especially those that have a tendency to harpoon me each and every time they get the feel, for no other reason.
I’m not going to leave. I’m going to be here. When you break my chops, I’m gonna break chops right back. That’s my nature. I don’t allow myself to get kicked around without response. I’ve been there and I’ve done that. And I don’t let big bad guys kick me in my butt and I’m not gonna allow certain individual here to do that without kicking back.
And I want to put this on the record that I’m sick and tired of these incidents, time and time again, every couple of weeks. If that’s the way they want it, we’ll continue that way until my time is up. But don’t be puttin’ your arms around me and greeting me and all that kind of stuff, when you’re kicking me in my butt as soon as I turn my back. I don’t like that. I know how to handle it. But I would appreciate if we’re gonna work as a team, we work as a team. If we’re not, then put your cards on the table. Be spontaneous. Let the chips fall where they may. Thank you very much.

Commissioner Martinez-- (This is one of Martinez's greatest sayings --- the granddaddy of them all ) --
"There are so many subtle ways of screwing the duck."
Mayor interjects --- "If I may say, I would only urge all Commissioners to use pleasant language." Martinez continues, --- "that it’s pathetic. Insofar as the comments of the police officers, I was not there as a Commissioner. I was there as a citizen who lives in Tuscawilla, lookin’ to annex a section of Tuscawilla to the main section. And when the police officers came, I didn’t tell them, "I’m a Commissioner, so back off". They spoke to me; I spoke to them. Mr. Khemlani was next to me. Ah ---- the person in charge of the Election Board came out and correctly certified that we were within the prescribed distance from the polling place. In fact, we were at least 20 ft. further than the prescribed distance and the police officers left after much tete a tete. No further discussion, they left satisfied.
They returned when Mr. Warner was there and they were subdued by the Church’s attorney, who insisted they remove the individual or place him under arrest and they chose to remove the individual, who was there legitimately. I wasn’t there to learn or know what transpired between them, but I know he went home and he called me and told me what transpired and I made it my business to address further to the Attorney General and get specifics on the law and the position of people like myself or any other citizen to be there electioneering on Election Day.
I am not faulting the police officers. Finally, they were in doubt as to what their position was when they ejected, ah, the gentleman in question, but I have gotten clarification and I hope that in the future, and before any action is taken, similar to this, that the police officer go back to his headquarters and get somebody to call the Attorney General and get a decision on the phone as to what is right and what is wrong, before they eject people. I’m not saying the police officers were at fault and, ah ---- I’m not faultin’ them for what they did. They were "bogarded"(?) by an attorney for the Church."

There it is --- your City Commissioner in one of the greatest confused monologs in the history of Winter Springs. Could it be this Commissioner is still going around the block? For sure, he couldn't still be in the alligator pits --- or is he? Could he be mad because he thought voting precinct #75 was the "Garden of Eden", and he got thrown out? Could they have kicked him in what he describes as "his butt"?
It must be a bottomless pit to sit at that dais knowing EVERYONE is against you. Whoops, forgot one. Commissioner Gennell agrees with the Commissioner. Gennell said Sandra Goard, Supervisor of Elections, should be notified, and St. Stephen's should be removed as a poll precinct.
This is for Commissioner Gennell --- SANDRA GOARD WAS NOTIFIED WHEN THE INCIDENT TOOK PLACE , and she concurred with the local officials there was a violation involved. Wake up and smell the coffee, Gennell --- it STINKS ! Commissioner Miller also would have sided with the Martinez/Gennell coalition --- he's part of it!

It's too bad the Orlando Sentinel doesn't provide coverage at the Winter Springs Commission meetings. Their coverage of the Oviedo Counsel meeting "HOO-HAH" would make it look like a children's Easter Egg Hunt ---- unless the kids were messing with Martinez's "ducks".
