 Supreme Court hears new challenge to land use initiative
 

A group that wants voters to have the final say on where new homes, roads and other developments are built took a second shot Monday at getting approval from the Florida Supreme Court to put their plan on the ballot.

          The justices narrowly rejected an earlier version of the proposed constitutional amendment. But they seemed more receptive because the amendment's sponsor deleted a sentence in the ballot summary that they had ruled was misleading and "emotional rhetoric." The high court made no immediate decision.

          Florida Hometown Democracy, though, already has missed a Feb. 1 deadline for submitting enough signatures for the ballot this year, but it has plenty of time for the 2008 election.

          The citizen initiative would require local governments to hold referendums on proposed changes in land use plans or when adopting new ones. Cities, counties and school boards are against that idea, saying it will grind local government to a halt.

          Lawyers for the opponents, however, were unable to make that argument Monday. That's because the Supreme Court's review is limited to whether the amendment meets constitutional requirements to cover only one subject and have a clear and unambiguous ballot summary.   Instead, they told the justices the amendment would affect multiple levels and agencies of government, violating the one-subject rule.

          The high court last year rejected that argument but ruled against the amendment in a 4-3 opinion. The rejected sentence stated that public participation in land planning benefits conservation, natural resources protection and the quality of life.

          The majority called that "emotional rhetoric" and noted land use includes more than those three factors such as traffic, utilities, housing and parks.

          Hometown Democracy lawyer Ross Burnaman told the justices the offending sentence has been removed and argued for approval as the justices previously found nothing else wrong with the amendment.

          Florida League of Cities lawyer Rebecca O'Hara told the justices the proposal now would affect multiple government agencies, due to a new law requiring plans to factor in classrooms and schools needed for future growth before that development occurs.

          "How does that interfere substantially with another branch of government?" asked Chief Justice Barbara Pariente. "I'm just not seeing it."

          O'Hara said voter rejection of city and county plans would affect the ability of school boards and the Legislature to provide new schools where they are needed and to comply with the Florida Constitution's class-size limits.

          Burnaman argued the constitution doesn't consider school boards to be local governments. He also said the Supreme Court already has determined class size can be met by methods other than building new schools and the amendment would not affect existing school property.

          Hometown Democracy is challenging the Feb. 1 petition deadline in a separate case set for a trial court hearing April 24 in Tallahassee. Even if it wins, the group probably couldn't gather enough signatures to get on the ballot this year, Burnaman acknowledged.

          It has collected only 69,317 verified signatures, slightly more than 10 percent of the 611,009 needed to get on the ballot.

Winter  Springs  Needs  Controlled !

            Winter Springs residents have seen the past ten years their operating budgets increase from $8 million dollars to over $45 million dollars, and their dais actions totally against the people of the City.    This includes their frenzied spending sprees of over $24 million dollars for their towncenter -- "Tiny Town" -- a project that can NEVER recoup the savage use of your tax dollars.   Projects that they can't complete, because of lack of funds (Example: The Parker Property Bond purchase), but yet increased their personal income during the past year --- with a whopping 74% in GIGANTIC pay raises.

             Controlled by a city manager who uses over $52,000 thousand tax dollars yearly invested by the City into his PERSONAL retirement package on and above that of the other employees of the city.   Your current elected (highly paid themselves) continues to give him this "GOLDEN-PARACHUTE" retirement package.    This must be halted!    Only honest candidates, and voters can accomplish this as an upcoming goal.    Find good people to represent you --- not like the current dais "lap-dog" clones.

             It is no hidden factor that the current dais has been labeled "Lap-dogs" by the Orlando Sentinel.    PFGG has even gone further to call this commission as being "McLemorized" by the manipulations of the current over-priced city manager "Ronnie" McLemore.    Make the goal for 2006 to re-establish a --

         Below is the instructions to sign the new petition.    Follow the instruction to the Florida Hometown Democracy web site, and copy the petition.    Fill it in and mail to these fine people so that we --- the people -- will have a say in controlling the State's growth before Florida becomes nothing but a concrete slab and parking lot.

STATE APPROVES NEW FLORIDA HOMETOWN DEMOCRACY PETITION. 

On Tuesday June 21, 2005 the Florida Division of Elections approved the NEW Florida Hometown Democracy Amendment Petition form.

“This amendment will give Florida voters the power to control local growth management.”  says its co-author, Lesley Blackner.  The Florida Hometown Democracy amendment will change the Florida Constitution to require that changes to local government comprehensive plans (and adoption of new plans) be subject to a referendum vote of local voters as the final step in the local approval process.  Currently, such votes are only made by county and city commissioners.

The original Florida Hometown Democracy Petition was first proposed two years ago, and over 50,000 verified petitions were accepted by the state.  However, on March 17, 2005, a sharply-divided Florida Supreme Court narrowly ruled (4-3) that the first sentence in the required “ballot summary” was an “editorial comment”, (although it was a direct quote from the Florida Constitution!), and struck the proposal.  Notably, all of the Justices found that, other than the first sentence of the ballot summary, the rest of the original ! Petition met all legal requirements. 

The NEW Petition is identical to the original Petition except that it strikes the first sentence of the ballot summary that was disapproved by the four Justices.

The Division of Elections’ approval means that supporters of the Florida Hometown Democracy amendment must now begin anew the process of collecting signed petitions. 

61,113 verified NEW Petitions must be filed with the Secretary of State to initiate the required Supreme Court review of the new Petition.  Given the Supreme Court’s prior opinion and our deletion of the first sentence in the ballot summary, it is highly probable that the Court will approve the measure for the 2006 ballot.
